If a fair player can turn a profit over an infinite sample, it isn't gambling. Or, absolutely everything is gambling.
You can't define an activity as "gambling" because it features an element of chance. You define it as "gambling" when every player has a negative expectation over an infinite sample. Otherwise, every speculative activity – real estate, mining, hedge funds, etc. – would also be classified as gambling. But they're not. Why? Because skill can, and routinely does, overcome the presence of any and all chance elements within those fields.
The USA needs to get its shit together. It's been almost two decades since UIGEA, and still, online poker is not organized at the national level. Almost every other country figured it out by now. Online poker desperately needs all those losers back! lol
